Practice Area 01
DUI / OWI Defense
Defending drunk and drugged driving charges under MCL 257.625 while protecting your license.
Michigan's drunk driving statute, MCL 257.625, covers several offenses: Operating While Intoxicated (OWI), including driving with a bodily alcohol content of 0.08 or more; the "High BAC" (super drunk) offense for a BAC of 0.17 or more; Operating While Visibly Impaired (OWVI); operating with any amount of a Schedule 1 controlled substance or cocaine in the body; and the "zero tolerance" offense for drivers under 21 with a BAC of 0.02 or more.

Possession, use, and delivery charges, including first-offender deferral and illegal search challenges.
Most Michigan drug crimes are charged under the Public Health Code. Possession is governed by MCL 333.7403, use by MCL 333.7404, and manufacture, delivery, or possession with intent to deliver by MCL 333.7401. The penalty depends on the substance's schedule and the amount involved.

We also defend charges such as armed and unarmed robbery (MCL 750.529 and 750.530), carjacking (MCL 750.529a), and home invasion (MCL 750.110a). Many of these carry lengthy prison terms and require careful attention to the sentencing guidelines from day one.

CCW, felony-firearm, felon in possession, and CPL-related charges.
Licensed carriers can face charges or license suspension for carrying in pistol-free zones, failing to disclose a CPL to police during a stop, or carrying with alcohol in their system (MCL 28.425f and 28.425k). Certain convictions, including many domestic violence convictions, can also lead to a firearms prohibition.

Probation Violation
Representation at violation hearings to keep probation in place and minimize jail.
Under MCL 771.4, a court may revoke probation and impose any sentence it could have originally imposed. A probation violation is handled at a hearing under Michigan Court Rule 6.445, where the prosecution must prove the violation by a preponderance of the evidence, a lower standard than at trial. You have the right to a lawyer, to notice of the alleged violation, and to present evidence.

Drunk & Disorderly Conduct
Resolving disorderly person charges before they become a permanent record.
Michigan's disorderly person statute, MCL 750.167, covers a number of behaviors, including being intoxicated in a public place and either endangering the safety of others or property, or acting in a way that causes a public disturbance (MCL 750.167(1)(e)). It is a misdemeanor punishable by up to 90 days in jail and/or a $500 fine under MCL 750.168. Many cities also have their own disorderly conduct ordinances with similar penalties.

Most moving violations in Michigan, such as speeding and careless driving, are civil infractions. Others, including reckless driving (MCL 257.626), driving while license suspended (MCL 257.904), and leaving the scene of an accident, are criminal misdemeanors that can carry jail time.
